The short version
- Play fair, have fun, and be at least 13 years old.
- Coins, boosters and other in-game items are for use in the Game only. They have no cash value and can't be exchanged for money.
- Purchases are generally final, except where the law says otherwise.
- We work hard to keep the Game running, but it's provided as it is.
1. Agreement
These Terms are an agreement between you and Copper Sky Games LLC, an Arizona limited liability company ("Copper Sky Games," "we," "us"). They cover our games and websites, including play.copperskygames.com (together, the "Game"). By playing the Game, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Game.
2. Who can play
You must be at least 13 years old to use the Game. If you're under 18, you need permission from a parent or guardian, who agrees to these Terms on your behalf and is responsible for any purchases you make.
3. Your account
You can play as a guest or sign in with Google or an email address. You're responsible for keeping your sign-in details secure and for activity on your account. Guest progress is tied to your device and may be lost if you clear your browser data or change devices; signing in protects it. You can delete your account at any time from inside the Game.
4. Virtual items
The Game includes virtual items such as coins, boosters, lives, crystals and chests ("Virtual Items"). Whether you earn them by playing or obtain them through a purchase:
- You receive a limited, personal, non-transferable license to use them within the Game. You don't own them.
- They have no monetary value and can't be redeemed for cash, sold, traded or transferred outside the Game.
- We may change, rebalance or discontinue Virtual Items or game features, including prices and rewards, as the Game evolves.
- If your account is deleted or terminated, its Virtual Items are lost.
5. Purchases
Purchases are sold and processed by Stripe, which acts as the reseller (merchant of record) for our in-game items, handles sales tax and VAT, and provides receipts and billing support. Your payment is also subject to Stripe's terms shown at checkout. All prices are shown before you confirm. When a purchase completes, the Virtual Items are delivered to your account right away. Because they're delivered immediately, purchases are final and non-refundable, except where required by law or where we decide otherwise in a particular case. If a purchase fails to arrive or you're charged in error, email us and we'll make it right. Chargebacks or fraudulent purchases may result in the removal of related Virtual Items or suspension of the account.
6. Playing fair
You agree not to:
- Cheat, exploit bugs, or use bots, scripts or hacks to gain an advantage or Virtual Items you didn't earn or buy.
- Interfere with the Game's servers, security or other players.
- Copy, reverse-engineer, resell or redistribute the Game, except as the law allows.
- Use the Game for anything illegal.
If you find a bug, please tell us. We appreciate it.
7. Our content
The Game, including its code, art, music, sounds, names and logos, belongs to Copper Sky Games LLC or its licensors and is protected by law. We give you a personal, non-commercial, revocable license to play the Game under these Terms.
8. Suspension and termination
We may suspend or close accounts that break these Terms or harm the Game or other players. We may also change or stop offering the Game. If we shut the Game down entirely, we'll try to give reasonable notice.
9. Disclaimers
The Game is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, including that the Game will be uninterrupted, error-free, or that progress or Virtual Items will never be lost.
10. Limitation of liability
To the fullest extent the law allows, Copper Sky Games LLC won't be liable for indirect, incidental, special or consequential damages, or for lost data or Virtual Items. Our total liability for any claim relating to the Game is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.
11. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Maricopa County, Arizona, unless the law where you live requires otherwise. Before filing a claim, please email us so we can try to resolve it informally.
12. Changes to these Terms
We may update these Terms. We'll change the effective date above and, for significant changes, let you know in the Game. Continuing to play after changes take effect means you accept them.
